Procedure of transshipment of grain

Sequence of procedures of the exporters when shipping grain via Ak Bidai -Terminal JSC (Aktau port)

Thetermsused:

Terminal– Ak Bidai-Terminal JSC-the grain terminal, located on the territory of the National Company Aktau International Sea Trade Port JSC. The terminal is operating within theappropriatecustoms authority zone.

Grain (cargo) – the commodity for export, with the qualitative characteristics complying with the standards, provided for by the legislation of the RoK, delivered to the Terminal by shipload lots in sealed railcars-grain carriers. Each lot shall go with the set of Cargo Customs Declaration and shipping documents.

Exporter - owner (seller) of grain. The Exporter has the right to independently perform all the procedures on export and transshipment of grain at the Terminal, including forwarding of the railcars, or entrust the Representative (representatives), authorized with the right to represent his interests to act on his behalf and on the instructions of the exporter of grain, in accordance with the legislation of the RoK.  

Comprehensive forwarder – the exporter’s agent who renders the full complex of services on organization of transportation of grain from the elevator to the vessel in the port (customs clearing, certification, allocation and forwarding of rail cars, organization of transshipment, freight etc.).

The port forwarder  – the exporter’s agent or the exporter’s comprehensive forwarder’s agent, who organizes transportation of grain from the Aktau port station to the vessel in the port, including organization of customs clearing, performing bills of lading,  cargo manifests and certificates, as well as forwarding of cargo by KaskorTransService JSC railways (from the Aktau port station to the Terminal).

The international inspection company – the company which carries out an independent expertise, inspection and checking of cargo (including qualitative characteristics of grain) and carriers (railcars, vessels etc.).

Surveyor  – the expert of the international inspection company, who carries out inspection of the vessels and cargo and gives conclusion about their condition and size. Besides, the surveyor consults the transporters and cargo owners, examines the procedure of checking-out, reviews certificates and documents etc.

Step 1.  Filing application to transshipment

1.1.

- makes a request to the Ak Bidai-Terminal JSC on rates applicable and terms of transshipment or turns to the electronic page of the Company at the website of the NC Food Contract Corporation JSC;

Step 2. Concluding agreements in the port

2.1.

Exporter**

-  independently or through the comprehensive forwarder/port forwarder concludes an Contract for transshipment with Ak Bidai-Terminal JSC.

- concludes an agreement and makes payment of services to KazkorTransService JSC for using of the branch railway from Aktau port station to the Terminal;

- agrees the date of arrival of the vessel with the Terminal.

Step 3. Ordering railcars and approval of the traffic of railcars-grain carriers

3.1.

Exporter***

 

-  carries out filing of the application to NC KTZ JSC for receiving of the Plan of railcars (the amount of railcars allocated, volume of cargo, station of unloading and destination). At the same time NC KTZ JSC ensures agreement of the Plan of railcars with NC AISTP JSC and Ak Bidai-Terminal JSC, and directing the Plan of railcars for execution at branches of the road, at the station of unloading and in Kaztemirtrans JSC;

Ak Bidai-Terminal JSC having reviewed the request, gives its permission or a justified refusal.

Criteria at which the Terminal does not agree with the plan of railcars:

- overloading of the Terminal’s capacities (absence of free capacities);  

- disregard of provisions of the Contract for transshipment of grain, namely, providing and coordinating with the Terminal of the Cargo delivery schedule, coordinating with the Terminal of the date of arrival of the vessel, as well as Exporter’s liability to inform on the name of the vessel, its cargo carrying capacity, owner of the vessel and shipping agent in the Aktau port.

Step 4. Shipping of cargo from the grain reception site

4.1.

Exporter**

- sends a request to Kaztemirtrans JSC for allocation of the necessary quantity of railcars at the station (s), makes payment of the railway rates and additional fees, receives railway codes and transport instructions;   

- makes payment of the railway rates and additional fees, receives railway codes and transport instructions;  

- submits applications at the stations of unloading indicating the date of providing and quantity of railcars placed;

4.2.

Exporter*

- carries out preparation of the set of cargo accompanying documents;

- railroad bills of lading;

- certificate of origin;

- phytosanitary certificate;

- veterinary certificate for forage;

- declaration of quality;

- certificate of quality;

- invoicesforeachrailcar;

-  other documents provided for by the export contract (example: certificate of the International Inspection Company).

 

4.3.

Exporter**

- carries out customs clearing of cargo for export at the station of unloading, and execution of cargo customs declaration (CCD);

 

Step 5. Intake of cargo to the Aktau sea port:

5.1.

Exporter*

- sends a letter of inquiry to the  NC AISTP JSC to get the pass to the docks area to execute formalities on grain transshipment;

- application sample (pdf);

5.2.

Exporter***

- informs Ak Bidai-Terminal JSC on terms of forwarding of the loaded railcars from the stations of unloading in writing;

5.3

Exporter***

-  carries out payment of the cargo harbor dues and other expenditures related to the delivery of grain to the docks area.

 

Step 6. Cargo execution and transshipment at the Terminal

6.1.

Exporter ***

- ensures credit clearance of the railcars at the Aktau port station;

 

6.2.

Exporter***

 

- ensures supply, cleaning and carrying out of shunting works continuously during unloading of the railcars through KazkorTransService JSC with uninfected grain to the receiving device of the Terminal;

 

6.3.

Exporter***

- ensures (before unloading the railcars) a prompt submitting to the laboratory of the Terminal of the selected samples to check for the infectiousness of grain;

 

6.4.

Exporter***

 

- ensures carrying out and processing of railcars in case if cargo is infectious, as the infected grain is not unloaded at the Terminal;

 

6.5.

Terminal

-  carries out (in accordance with the agreement) acceptance of railcars-grain carriers of the exporter;  

 

6.6.

Exporter***

-  after unloading of barley carries out disinfection of railcars;

 

6.7.

Terminal

-  carries out weighting of grain and directs into free silos;

 

6.8.

Exporter****

-  ensures presenting of the vessel for loading on the date agreed with the Terminal;

 

6.9.

Exporter***

- ensures the vessel passing of the boarder and customs control;

- ensures examination of the holds of the vessel by the surveyor for its suitability for the transportation of grain;

- ensures examination of the vessel by the inspection on plant quarantine;

- ensures desinsection of the holds during loading of barley.

 

6.10.

Exporter***

- carries out pre-loading registration of grain and preparation of cargo accompanying documents:

- quality certificate;

- certificate of weight;

- certificate of origin;

- phytosanitary certificate;

- certificate of radioactivity;

- certificate of health;

- certificate of fumigation;

- other documents provided for by the export contract (for example: certificate of the international inspection company).

 

6.11.

Terminal

Carries out shipment of grain to the vessel

 

6.12.

Exporter***

Ensures fumigation of cargo aboard the vessel;

 

6.13.

Exporter***

Ensures the final draft of the vessel

 

6.14.

Exporter***

- prepares the bill of lading (the document of the captain of the vessel about the intake of cargo);

- cargo-manifest (the document containing the list of all the data on the shipped cargo, aboard the vessel);

6.15.

Exporter***

Ensures establishment of the committee (port administration, customs, border service and other), which checks the vessel before its departure from the port

 

6.16.

Exporter***

Forwarding the vessel to the destination

 

*          these operations shall be executed by the exporter;

**    these operations may be executed by the exporter himself or through the comprehensive forwarder;

***   these operations may be executed by the exporter himself or through the comprehensive forwarder or through the port forwarding agent;

****  ***   these operations may be executed by the exporter or the buyer .

 

It should be noted:

  • storage of each ton of the Cargo at the grain terminal during the first 7 (seven) days from the moment of intake is free;
  • the cost of storage of each ton of Cargo starting from day eight, is KZT 10 per ton for each day of storage;
  • In case if the vessel does not arrive on the dates agreed and non-agreement with the Terminal of a later date of arrival of the vessel, the Exporter apart from paying for storage, pays a fee in the amount of KZT 150 (one hundred fifty) per ton a day, starting from the pre-agreed date of arrival of the vessel.
